TERMS AND CONDITIONS OF SALE
 
 
  1. General disposition
1.1. The following terms and conditions of sale (“Terms and Conditions of Sale”) apply to the offer and sale of products through the website www.eleganza.mx (“Website”).
 
1.2. In order to purchase products on the Website, customers must:
(a) be at least 18 years old or, if they are minors, be duly authorized by their legal guardian,
(b) be consumers, understood as such natural persons who act for purposes outside their industry, trade, business and profession
(c) register on the Website; and
(d) have a valid credit or debit card.
 
1.3. This contract will be formalized in Spanish and will be regulated by Mexican legislation according to the General Law of Credit Instruments and Operations, as well as the Federal Consumer Protection Law and the Federal Economic Competition Law.

3.1. Information about the products is available on the Website, which is provided in accordance with the provisions of the Federal Consumer Protection Law.
 
3.2. We will take all reasonable precautions to ensure that all product details, descriptions and images appearing on the Website are correct at the time the relevant information is entered into the system; However, to the extent permitted by applicable law, we do not guarantee that such product details, descriptions and images are accurate, complete, reliable, up-to-date or error-free.
 
3.3. The products described on the Website and the samples thereof that, where appropriate, we provide to the client are exclusively for personal use, therefore they will not be labeled for sale. Customers may not sell or resell such products or samples. We reserve the right, with or without notice, to cancel or reduce the quantity of products or samples to be delivered to the customer where, in our sole discretion, this constitutes a breach of these Terms and Conditions.
 
  1. Prices
 
4.1. All prices indicated for the products that are available through the Website include VAT at the current rate and are denominated in legal tender in the Mexican Republic, that is, Mexican pesos. Shipping costs will be added to the price of the products and are indicated separately on the order form.
 
4.2. We regularly check the correctness of all prices displayed on the Website, however, to the extent permitted by applicable law, we cannot guarantee the absence of errors. If an obvious error in the price of a product is detected, we will provide the customer with the opportunity to purchase the product at the correct price or cancel the order.
 
  1. Placing Orders
 
5.1. To place an order, the customer must follow a series of simple instructions that appear on the Website.
 
5.2. To place an order, the customer must enter the quantity, size and color of the product they wish to purchase.
 
5.3. The customer must click on “Add to cart” to place the selected product and the desired quantity in the shopping cart. The customer can check the products that are included in the shopping cart at any time during the purchasing process by clicking on “Cart” on each page. The customer can save a product to favorites by clicking on “add to cart” under the product name, after which the product will be in the customer's “Cart” section in “My Account”. 5.4. The customer must follow the instructions that appear on the screen to execute the checkout process. The customer can always correct any error in the data entered, change the contents of the shopping cart by including or removing one or more products from the cart or cancel the entire order during the “checkout” process before formalizing the order. By placing an order, the customer acknowledges and declares that he or she has read all the instructions given during the checkout process and fully accepts these Terms and Conditions. The customer places an order for products through the Website by clicking on the Send button at the end of the order process.
 
5.5. Once the order has been sent, a “Thank you for placing your order at Eleganza Regalos” page will appear and shortly after, the customer will receive an email confirming receipt of the order. In accordance with the provisions of the Federal Consumer Protection Law, the order confirmation email contains a summary of the Terms and Conditions, information on the essential characteristics of the purchased products, a detailed indication of the price and the manner of payment, information on shipping costs, information on the conditions and methods to exercise the right of withdrawal, the address for sending complaints and information on support services and existing commercial guarantees.
 
5.6. If the confirmation of an order does not arrive within 24 hours of its formalization, the customer can contact us for assistance at eleganzaregalos@gmail.com.

  1. Offer Codes
 
6.1. To redeem an offer code, the customer must enter their code in the “promotion code” box during the checkout process on the Website. Offer codes are case sensitive and should always be entered exactly as they appear.
 
6.2. When an offer code is accepted, the offer will be displayed in “Order Review”.
 
6.3. One offer code may be used per order.
 
  1. Payment options
 
7.1. The customer can pay for the products through Paypal, Cash Deposit in Bank Account, Direct Payment in OXXO Stores, Credit or Debit Card. The following credit cards are accepted for this purpose:

7.2. We accept credit or debit cards with billing addresses that are located outside of the Mexican Republic.
 
7.3. The products will be charged to the customer at the time of confirming the purchase, in accordance with the provisions of article 15 of the Federal Consumer Protection Law.
 
7.4. For customer security, the customer's name and billing address must match the credit card used to make payment. We reserve the right to cancel any order that does not meet these criteria.
 
7.5. All credit card holders are subject to validation and authorization checks by the card issuer. If the issuer of the customer's payment card denies, or for any reason does not authorize, payment to us, whether before or after a payment, we will not be liable for any delay or non-delivery.
 
  1. Order Inquiries
 
8.1. Generally, products are shipped within an estimated time of five days from receipt of an order. To obtain information about a shipment, the customer must contact us by email at the following address: Eleganzaregalos@gmail.com.
 
8.2. Through their Eleganza account, customers can check the status of their most recent orders by visiting the Order Status page in the My Account section. This is the easiest and fastest way to get the most up-to-date information regarding orders.
 
8.3. When the customer clicks on the Order Status page, they will be asked to log in with their email address and password. The customer will be informed in detail about their current and previous orders on the order summary page. Once the order is shipped, the corresponding tracking number will be displayed, if available. Customers can track the delivery of their order through our transport company by clicking on “Courier Company” under the Order Status heading. Some shipping companies may not have tracking information available until twenty-four hours after the order is shipped.
 
8.4. Occasionally, our system cancels orders or parts of an order for various reasons. Some of these reasons are:

Inability to process payment information
Impossibility of delivering to the address provided
Placing a duplicate order
Cancellation at the request of a client
 
8.5. If an order is cancelled, the customer will receive an email explaining the reasons for the cancellation. The customer will not be charged for canceled orders.   1. Delivery
 
9.1. Orders are processed and delivered exclusively on business days (Monday to Friday, excluding holidays). Orders placed on Saturday and Sunday will be processed the next business day.
 
9.2. We cannot process orders with a delivery address in a PO box.
 
9.3. Shipping costs will be borne by the customer and are indicated separately on the order form and on the delivery note. Shipping costs will not be charged for purchases greater than the amount we show on the Website.
 
9.4. In accordance with the Federal Consumer Protection Law, the products will have an estimated delivery date within five days following the purchase by the customer, unless within the same period we notify the customer, including by email, in the same period, that the ordered products are not available, even that they are temporarily unavailable.
 
9.5. Shipments will only be made within the Mexican Republic.
 
  1. Right of Termination
 
10.1. We are committed to offering customers the best products available. If the customer considers that the products they have received do not meet this expectation, in accordance with the provisions of the Federal Consumer Protection Law, the customer will have the right to terminate the contract, citing the cause, within five business days. following the date of receipt of the products.
 
10.2. The customer may notify his intention to exercise the right of withdrawal by sending us an email to eleganzaregalos@gmail.com with the details of the relevant order, including the customer's order number and the description of the products being returned. Inside the order packaging, the customer will find a shipping note with details of the order and details about our return procedure. 10.3. Our Customer Service department will then issue the customer an authorization number and an email confirmation. The customer is invited to save his authorization number for future consultation with the Customer Service department in this regard.
 
10.4. In the event that the customer returns products for reasons other than that they are defective or that their delivery has been incomplete or incorrect, they must arrange and pay for their return.
 
10.5. In the event of exercising the right of termination, we undertake to refund the customer the full price of the products within thirty business days following the date on which the termination is received and confirmed, provided that the products are returned unused and undamaged. returned products, having been maintained and handled with due care and attention, within five business days of delivery. Refunds will only be made against the credit or debit card originally used. Once the refund has been made, we will notify the customer by email.
 
10.6. It is highly recommended to send the package using a registered delivery service (which requires a signature upon delivery). We cannot be responsible for returned products that are lost during transit.
 
10.7. The above provisions only apply to purchases made online. Products purchased directly from the establishment will be subject to the establishment's corresponding return policy. Returns or exchanges of purchases made at the associated direct sales establishment cannot be returned or exchanged through the Website, in the same way purchases made online will not be accepted for return or exchange at the establishment.
 
 
  1. Lack of Compliance
 
11.1. In case of lack of conformity of the products with the contract in accordance with the provisions of article eighty-two of the Federal Consumer Protection Law. The customer has the right to have the products repaired or replaced, free of charge, so that they comply with the contract, failing which the customer has the right to a reduction in the price of the products or to cancel the contract. The customer waives the rights described above if he does not notify us of the lack of conformity within five days from the date on which he received the product. In any case, actions initiated in relation to a lack of conformity that we have not maliciously concealed will automatically expire six business days after delivery of the products.
 
  1. Applicable law and jurisdiction
 
12.1. These Terms and Conditions are regulated by the legislation in force in the Mexican Republic and must be interpreted in accordance with Mexican laws.
 
12.2. Conflicts that, if applicable, arise from the interpretation, validity and/or execution of these Terms and Conditions will be submitted to the jurisdiction of the courts and tribunals of Mexico City, Mexico, with the parties renouncing the jurisdiction granted to them. may apply due to your domicile.
